Judges in California Reverse Ruling Preventing CART in Classrooms

In California this week, two families with hard-of-hearing daughters won their four year battle for equal rights with Tustin Unified School District in Orange County and Poway Unified School District in San Diego County.

The cases first began when the two girls were both denied Communication Access Real-time Translation (CART)—which transcribes spoken material word-for-word.

Both girls testified that even though they were not completely deaf, understanding the class material still required much effort from them. The school district later denied both students CART transcription, but offered different accommodations under Title II of the Americans with Disabilities Act (ADA) and Individuals with Disabilities Education Act (IDEA).

Despite the families’ earlier losses in court, they gained their victory in a three-judge panel on August 6th.
